“Fire It Up for an Extreme Ranch Journey” Vehicle Giveaway with 95.9 The Ranch and Frank Kent Dodge is open only to legal residents of the United States of America who are eighteen years of ageat the time of entry. Employees, officers and representatives of LKCM Radio Group, LP, Frank Kent Motor Company and Extreme Beverage Company, LLC and their respective related companies, as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. This Sweepstakes is subject to all federal, provincial, state and local laws and regulations. Odds of winning depend on the number of eligible entries received. Void where prohibited by law.

By participating in the Contest, each Entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Contest.

 

The Contest begins at 12:00 Noon Central Daylight Time (CDT) Saturday, October 25^th, 2008 and continues through Saturday, December 20, 2008.

 

 

 

On October 25,2008 people that come to Ranch Bash ’08 in Sundance Square, Downtown Fort Worth will be directed to the Frank Kent Tent and The Fire It Up Extreme Energy Drink Tent to register to win a key that could “Fire It Up” to win the 2009 Dodge Journey. A Frank Kent Dodge or Extreme Energy Drink representative will take their name, email and cell phone number.

 

Designated promotional personnel will also gather names, emails and phone numbers. Key Winners will be selected from entries with verifiable emails only.

 

A total of six (6) keys will be given away during Ranch Bash (between each act). The Key Winners name will be called out from the stage, and directed to the Ranch Merchandise Tent to pick up their key. “Keys” will actually be Ranch Certificates redeemable on December 20, 2008 only at Frank Kent Dodge.

 

 

There will be a total of 95 Keys given away between October 25 and December 20^th, when winners will go to Frank Kent Dodge to see if their Key will “Fire It Up” to win the 2009 Dodge Journey during the final Ranch Remote Broadcast.

 

Keys given away:      6ea.    During Ranch Bash

 

Listeners can only win one (1) key per person during the duration of the contest.

 

On-air, and Key Hits winners will be told that they must pick up their Key Certificate at the Station in Fort Worth. Key Winners must be 18 years of age or older and provide a current, valid drivers license.

 

 

Listen every morning Mon-Fri at 7:20am to find out when the next Key will be given away on the air and when to listen for the “Fire It Up Sound-bite”. Possible times will be between 7:20am and 7:00pm. One (1) to two (2) Keys may be given away On-Air each day through December 19^th.

 

The “Fire It Up Sound-bite” will be played, and the 9^th caller will be asked to pick a Radio Pre-Set Button. They will have a choice of Pre-Set Button #1 or Pre-Set #2.

 

If the Pre-Set Button they choose is set on Nashville Music, they are a loser and can try again later. If the pre-set they pick is set on 95.9 The Ranch, they win one of the Keys that might “Fire It Up For An Extreme Ranch Journey” on December 20^th and win a Dodge Journey from Frank Kent Dodge.

 

Pre-produced Sound Effects will indicate whether or not the Pre-Set Button chosen is on The Ranch or on a Nashville Music station

 

The Program Director of 95.9 The Ranch will pre-determine the winning pre-set number in advance of the contest. The on-air Disc Jockey will not be in control of determining the winning number.

Engine Revved up, Phone Tones & and, (singing) The Ranch!

 

Winner FX: Car Door slams, Car cranks, Radio comes on with Ranch singing “The Ranch” & TX Music playing (instrumental to music bed of Live version of “Road Goes On Forever”)

 

Loser: FX: Car Door slams, Car cranks, Radio comes on with Nashville Music playing Rascal Flats or Faith Hill… sappy music bed continues while DJ tells them they need to Pre-Set It or Regret It … try again Today /Tomorrow at XX time.

 
 

 

From October 27 to December 19, The Ranch will be on location weekday’s 11:30am to 1pm at various retail stores.

 

The wrapped Dodge Journey will be used on all locations. Listeners can come by and enter the drawing to win a Key as well as Fire It Up products. One (1) Key Winner will be drawn from the entries from each day’s location. Contestants can register daily.

 

The On-Air DJ will announce the Key Winner between 1pm and 1:30pm and give the location for the next days Key Hit.

 

From October 27 to December19, The Ranch will be on site at Frank Kent Dodge every Saturday. Listeners can come by and enter the drawing to win two (2) Keys during each remote broadcast. Key Winners will be drawn from the entries from that day’s remote, and announced at the end of the remote.

 
 

            12:30 pm – Final key Qualifier is drawn from on site at Frank Kent Dodge – On December 20, 2009 this will be one lucky listeners last chance to win a key that  may start the Frank Kent Dodge Journey… At 12:30 pm the final key qualifier will be drawn…

            12:45 pm to 1:45 pm - All 95 Key Certificate Holders begin to sign in at the  95.9 The Ranch Booth. Key Certificates must be presented by each qualifier at time of sign in. Each participate will reach into the hopper to draw a number…This number will provide placement regarding key drawing.   

 

Each contestant must be eighteen years of age at the time of entry and be able to provide proof with a valid driver’s license.  

 

Saturday, October 25^th, 2008 through Saturday, December 20^th, 2008.

 

The Sponsor’s decision as to the administration of the Contest and the selection of the winner are final and binding. The promotion will take place on Saturday, October 25th through Saturday, December 20^th, 2008. The Contestants must comply with all terms and conditions of these Official Rules. The actual award of the Grand Prize is contingent upon fulfilling all requirements (including the Winner executing the Release, Waiver, and Assumption of Risk and the Publicity Release (collectively the “Release’.) To receive the Grand Prize, the Winner must sign and return to the Sponsor an Affidavit of eligibility and the Release within two (2) days of the date of notice. If the Winner cannot be notified within a five (5) day period, or fails to sign and return the Affidavit or Eligibility and Release within the five (5) day period, the Winner shall forfeit the Grand Prize. In the event that the Winner is disqualified for any reason, the Sponsor will seek to award the Grand Prize to an alternate Winner by conducting additional drawings until the Grand Prize is awarded. The Grand Prize will be awarded subject to the terms and conditions of these Official Rules.

 

 

No substitution, assignment of transfer of any of the prizes is permitted, except by Sponsor, who reserves the right to substitute any of the prizes or a component of the Grand Prize with another of comparable or greater value. No cash substitution is available. 

 

Entrant has not yet won the Grand Prize and entry into the Sweepstakes does not guaranty that such Entrant will be the Winner. No purchase is necessary to enter the Sweepstakes or to win. Overall odds of winning depend on the number of eligible entries received. Only one Grand Prize shall be awarded. Void where prohibited by law.

 

Except where prohibited, participation in the Sweepstakes constitutes to the Sponsor’s use of the Winner’s name, image, likeness, voice, opinions, biographical information, hometown and state for promotional and marketing purposes in any media without further payment or consideration.

 

The Sponsor reserves the right to cancel or modify the Sweepstakes if fraud, technical failures or any other factor beyond the Sponsor’s reasonable control impairs the integrity of the Sweepstakes, as determined by the Sponsor in its sole discretion. The Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules, or upon the Sponsor’s belief said individual is in violation of any state or federal law or regulation, or is acting in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the sweepstakes is in violation of criminal and civil law, and should such an attempt be made, the Sponsor reserves the right to prosecute and/or seek damages from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any provision of these Official Rules.

 

BY ENTERING THIS CONTEST ENTRANT AGREES TO RELEASE AND HOLD HARMLESS KFWR 95.9 The Ranch, Frank Kent Dodge, Fire It Up Extreme Energy Drink AND EACH OF THEIR RELATED AND AFFILIATED COMPANIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS OR CAUSES OF ACTION ARISING OUT OF PARTICIPATION IN THE SWEEPSTAKES OR RECEIPT OR USE OF THE GRAND PRIZE IN ANY RESPECT.

 

The Sponsors are not responsible for: (i) technical failures of any kind including, but not limited to, the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of entries, whether caused by the sender or any of the equipment or programming associated with or utilized in the Contest by an Entrant, the Sponsors; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process of the Contest; (iv) electronic or human error which may occur in the administration of the Contest or the processing of entries; or (v) any injury or damage to persons or property including, but not limited to, any Entrant’s computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from any Entrant’s participation in the Contest.

 

Entrant understands and expressly agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Contest, or the Grand Prize awarded, other than the administration of the Contest or the determination of the Winner shall be resolved individually, without resort to any form of class action, and exclusively by the laws of the State of Texas; (ii) and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest but in no event shall attorney’s fees be awarded; and (iii) under no circumstances will Entrant be permitted to seek or obtain awards for punitive, incidental and consequential damages and any other damages including, without limitation, treble damages, and Entrant hereby expressly waives all rights to any such

claims. SOME JURISDICTIONS DO NOT ALLOW THE FOREGOING LIMITATIONS OR THE EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NO APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of an Entrant, in connection withy the Contest, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas. In the event of any dispute or action to enforce these Official Rules, the parties agree to the exclusive jurisdiction and venue in the District Court for the City and county of Tarrant, State of Texas.

 

Sponsor intends to use, solely for Sponsor and Sponsor’s affiliate’s use, Entrant’s personal information for marketing, informational and promotional purposes. All information collected from an Entrant is subject to LKCM Radio Group Privacy Policy.

  

 

 

Currently the Title Holder of the 2009 Dodge Journey is held by LKCM Radio Group LP. Before taking ownership of the 2009 Dodge Journey supplied by Frank Kent Dodge the Vehicle wrap must be removed and the winner must provide PROOF OF INSURANCE.    Winner is also responsible for any fees and taxes incurred with the title transfer to his or her name. 95.9 The Ranch will provide the proper paperwork for tax purposes (W-9) and winner will receive a 1099 for tax purposes at the end of the year. There is NO Buy Out Option available. The new owner of the vehicle can pick up his/her new 2009 Dodge Journey on Tuesday, December 23^rd, 2008 from the 95.9 The Ranch Studios located at 115 W. 3^rd Street, Fort Worth, TX  76102.   

KFWR 95.9 The Ranch is scheduled to have the 2009 Dodge Journey Vehicle Wrap removed on Monday, December 22, 2008.
